Scope of Agreement
1.1 The Freelancer agrees to provide services as an independent contractor through the 369.energy platform, adhering to the terms and conditions outlined in this Agreement. 1.2 The Freelancer is not an employee, agent, or representative of 369.energy and will operate as an independent professional responsible for their actions and obligations.

Freelancer Responsibilities
2.1 Professional Conduct: Freelancers must adhere to the Code of Conduct outlined on the platform, including but not limited to the following:

Confidentiality and respect for client property and data.

Prohibition of extortion or coercive practices.
2.2 Service Standards: Freelancer agrees to deliver high-quality services in compliance with the terms agreed upon by the subscriber.
2.3 Identification and Verification: Freelancer will provide:

Government-issued photo identification.

Professional license (if applicable).
-
Local authorities issue fingerprint verification.
-
Certification of training in work ethics and professionalism.

Upload copies of all IDs, transcripts of credentials, certifications, and issued fingerprint records, as applicable. The uploaded files must pertain specifically to the requested documents as outlined. Freelancers must also provide contact information for the Police Station or Sheriff's Department where fingerprints were obtained, if applicable.
2.4 File Upload and Security: The platform will provide a secure file upload system for submitting required documents. This system will feature a clearly labeled ‘Upload Files Here’ arrow or button to guide Freelancers through the process. Uploaded files will be securely stored and attached to the Freelancer’s profile for administrative review and approval. The Freelancer acknowledges their accuracy and compliance with platform standards by uploading these documents.
2.5 Ownership: Freelancer acknowledges that all files, written or otherwise, created during the engagement remain the sole property of the subscriber upon payment. 2.1 Professional Conduct: Freelancers must adhere to the Code of Conduct outlined on the platform, including but not limited to the following:

Administration Fee
3.1 A 15% administration fee for each completed transaction will be deducted from the Freelancer's earnings. 3.2 Breakdown of the administration fee:

10% for platform maintenance and security.

3% for transaction processing.

2% for customer support and dispute resolution.
Freelancer Fees and Customer Responsibilities:

Completion of Services and Sign-Offs
The subscriber (client) and the freelancer must mutually agree that services have been completed satisfactorily. This ensures that neither party has full control over the determination of service completion, creating a balanced and fair system.

Upon completing the agreed service, the freelancer must submit a Service Completion Report by selecting the "Completion of Work Fulfilled" option via the platform.

The subscriber (client) will review the submission and must approve or provide feedback through the platform within 24 hours of submission. The subscriber may click "Services Completed" or "Services Not Completed."

A check-off box for service completion and fields for digital DocuSign signatures will be available for both the freelancer and the subscriber. Both parties must sign and date this acknowledgment, which will serve as the final record of the completed service.

Automated Approval and Dispute Policy

Payment Release Process

Payment to the freelancer will only be initiated after both parties complete the check-off process and sign the acknowledgment through the platform.

We will withhold payment if someone files a dispute until the platform’s dispute resolution process resolves the issue.

Cancellation and Missed Appointments Policy
Effective January 1, 2025, appointments canceled within 48 hours of the scheduled service will incur a 35% cancellation fee, charged to the subscriber’s credit card.
Appointments missed without notice will incur a 100% fee, ensuring freelancers are compensated for their time and commitment.
This policy demonstrates courtesy to service providers by allowing them to reschedule canceled appointments or accept other bookings. It also encourages subscribers to honor their commitments or provide timely notice of cancellations.

Freelancer Fees
A 15% administration fee will be deducted from the freelancer’s earnings for each completed transaction.
This fee includes:
10% for platform maintenance and security.
3% for transaction processing costs.
2% for customer support and dispute resolution.
Freelancers are encouraged to set fair service pricing and factor in this administrative deduction when determining their rates.

Confidentiality
5.1 Freelancer agrees to maintain strict confidentiality of any proprietary information, data, or content provided by the subscriber. 5.2 Freelancer is prohibited from retaining, copying, or sharing subscriber files after payment is executed.

Termination
6.1 Either party may terminate this Agreement with [Insert Notice Period] written notice. 6.2 The Administration reserves the right to terminate the Freelancer's access to the platform for violations of this Agreement or the platform's policies.

Indemnification

8.1 Any disputes between the Freelancer and the Administration will be resolved through mediation before pursuing legal action. 8.2 All disputes will be governed by the laws of [Insert Jurisdiction].

Entire Agreement
9.1 This Agreement constitutes the entire Agreement between the Freelancer and 369.energy and supersedes all prior agreements. 9.2 Any amendments to this Agreement must be made in writing and signed by both parties.
